On our website we give you the opportunity to subscribe to a newsletter. To avoid errors when entering data or data misuse, we use the so-called double opt-in process. We send you an email with a link to confirm your registration. If you do not confirm your registration within 48 hours, your information will be blocked and automatically deleted after one month. Only when you click on this confirmation link will your email address be added to our mailing list. Your electronic contact details are processed at this point solely on the basis of your consent (Article 6 Paragraph 1 Letter a of the GDPR). By registering, you consent to us collecting and processing the customer master data and information on purchasing behavior stored in your customer account. Based on this information, we will send you personalized advertising in the form of a newsletter. This appears regularly and informs you about new products, promotions and discounts, as well as opportunities to win. If we receive your email address in connection with the sale of a product or service and you have not objected to this, we reserve the right to regularly send you offers for similar products from our range to those you have already purchased by email on the basis of Section 7 Paragraph 3 of the German Unfair Competition Act. This serves to protect our legitimate interests in advertising to our customers, which prevail in the context of a balancing of interests. You can object to this use of your email address at any time by sending a message to the contact option described below or via a link provided for this purpose in the advertising email.

According to the European Court of Justice, an adequate level of data protection cannot currently be assumed in the USA.

Klaviyo uses so-called standard contractual clauses pursuant to Art. 46 (2) and (3) GDPR ( https://eur-lex.europa.eu/eli/dec_impl/2021/914/oj?locale=de ) as the basis for processing or transferring data to countries outside the EU. Through these clauses, Klaviyo undertakes to comply with the EU data protection standard when processing your data, even if the data is transferred to third countries such as the USA and processed and stored there. You can find out more on Klaviyo's website at https://www.klaviyo.com/legal/data-processing-agreement and https://www.klaviyo.com/legal/privacy/privacy-notice

The newsletter is sent as part of processing on our behalf by a service provider to whom we pass on your e-mail address for this purpose. We would like to point out that we evaluate your user behavior when the newsletter is sent. We use tracking pixels to record information on the number of opens and clicks on newsletter issues as standard. You can unsubscribe from the newsletter at any time. We provide you with a corresponding link at the end of each advertising email. You can also contact us at the following email address: hey@windandvibes.com to request information about or to have your data deleted. Data that we have stored for other purposes (e.g. e-mail addresses as part of the purchase process) remains unaffected. Your revocation does not affect the legality of the processing of your data for the respective purpose based on your consent until the revocation. Postal advertising and your right of objection We also reserve the right to use your first and last name and your postal address for our own advertising purposes, e.g. to send you interesting offers and information about our products by post. This serves to protect our legitimate interests in advertising to our customers in accordance with Art. 6 Paragraph 1 Clause 1 Letter f of GDPR, which prevail within the framework of a balancing of interests. The advertising mailings are carried out as part of processing on our behalf by a service provider to whom we pass on your data for this purpose. Google AdSense

Our website markets space for third-party ads via Google AdSense. These ads are displayed to you at various points on this website. The so-called DoubleClick cookie enables the display of interest-based advertising by collecting and processing data (IP address, time of visit, device and browser information, and information about your use of our website) and automatically assigning a pseudonymous user ID, which is used to determine interests based on visits to this and other websites.

Google Ads

For advertising purposes in Google search results and on third-party websites, the so-called Google remarketing cookie is set when you visit our website, which automatically enables interest-based advertising by collecting and processing data (IP address, time of visit, device and browser information, and information about your use of our website) and using a pseudonymous cookie ID and based on the pages you visit. Any further data processing only takes place if you have activated the "personalized advertising" setting in your Google account. In this case, if you are logged in to Google while visiting our website, Google will use your data together with Google Analytics data to create and define target group lists for cross-device remarketing.

For website analysis and event tracking, we use Google Ads Conversion Tracking to measure your subsequent usage behavior if you have accessed our website via a Google Ads ad. Cookies may be used for this purpose and data (IP address, time of visit, device and browser information as well as information on your use of our website based on events specified by us, such as visiting a website or registering for a newsletter) may be collected, from which usage profiles are created using pseudonyms.

If your internet-enabled devices are linked to your Microsoft account and you have not deactivated the “interest-based advertising” setting in your Microsoft account, Microsoft can create reports on usage behavior (in particular the number of users across devices), even if you change your device, so-called “cross-device tracking”. We do not process personal data in this regard; we only receive statistics created on the basis of Microsoft UET.

As part of the so-called extended data comparison, information is also collected and stored in hashed form for comparison purposes, with which individuals can be identified (e.g. names, e-mail addresses and telephone numbers). For this purpose, when you visit our website, the Facebook Pixel automatically sets a cookie that automatically enables your browser to be recognized when you visit other websites using a pseudonymous cookie ID. Facebook will combine this information with other data from your Facebook account and use it to compile reports on website activity and to provide other services related to website usage, in particular personalized and group-based advertising.

Joint responsibility is limited to the collection of data and its transmission to Facebook Ireland. The subsequent data processing by Facebook Ireland is not included in this.

Based on the statistics on visitor activities on our website created via Facebook Pixel, we use Facebook Custom Audience to run group-based advertising on Facebook by determining the characteristics of the respective target group. As part of the extended data comparison (see above) that takes place to determine the respective target group, Facebook acts as our processor.

Based on the pseudonymous cookie ID set by the Facebook Pixel and the data collected about your usage behavior on our website, we operate personalized advertising via Facebook Pixel Remarketing.

We use Facebook Pixel Conversions to measure your subsequent usage behavior for web analysis and event tracking if you have reached our website via a Facebook Ads advertisement. The data processing is carried out on the basis of an agreement on order processing by Facebook.
